You have indicated that you are currently registered or enrolled in another state or territory of Australia or in New Zealand

Persons who are registered or enrolled in another state or territory of Australia may be eligible for registration under the provisions of the Mutual Recognition Act 1992 (Commonwealth) which has come into effect where state and territory parliaments have passed enabling legislation.

Similar provisions exist in the Trans Tasman Mutual Recognition Act 1997 (Commonwealth) in regard to persons registered or enrolled in New Zealand.

In order to be eligible you must be able to answer the following statements.  If not, you are not eligible and should not apply under mutual recognition provisions.

Requirements for Eligibility under Mutual Recognition

I am able to declare on oath ALL of the following:
  • I am currently registered, enrolled or authorised to practise as a nurse or midwife (or nurse practitioner or midwife practitioner) in another state or territory of Australia or in New Zealand;
  • I will provide a copy of my current practising certificate in that place with my application for registration, enrolment or authorisation in New South Wales;
  • I will also specify all the States in which I have substantive registration for equivalent occupations;
  • I am not the subject of disciplinary proceedings in any state or territory of Australia or in New Zealand;
  • I am not the subject of any preliminary investigations or action that might lead to disciplinary proceedings in relation to practice as a nurse or midwife in any state or territory or New Zealand.
  • I have not had registration, enrolment, authorisation as a nurse or midwife cancelled or currently suspended as a result of disciplinary action in any state or territory of Australia or in New Zealand;
  • I am not otherwise personally prohibited from carrying on the occupations of nursing and/or midwifery in any state or territory of Australia or in New Zealand;
  • I am not subject to any special conditions in carrying on the occupations of nursing and/or midwifery, as a result of criminal, civil or disciplinary proceedings in any state or territory of Australia or in New Zealand;
  • I will specify any special conditions to which I am subject in carrying on the occupations of nursing and/or midwifery in any state of Australia or in New Zealand;
  • I give consent to the making of inquiries of, and the exchange of information with, the authorities of any state or territory of Australia or New Zealand, regarding my activities in the relevant occupation or occupations or otherwise regarding matters relevant to the notice I intend to lodge with the Nurses and Midwives Board.
  • I acknowledge that any person who wilfully and corruptly makes and signs a statutory declaration, while knowing that any part of it is untrue, may be guilty of an indictable offence and liable to imprisonment for five (5) years.
     
If you agree to EVERY ONE of the above statements, and are prepared to make a statutory declaration, acknowledging penalty of imprisonment if convicted of making a false declaration, you may lodge an application under mutual provisions. If so, you may download and complete the Application under the Mutual Recognition Act 1992 or the Trans Tasman Mutual Recognition Act 1997.

The application must be submitted in person or by post. Statutory declarations cannot be submitted by electronic means.
